In the event that Marine Quest is unable to put to sea due to mechanical failure or any other limitation, we reserve the right to terminate the contract with the charter party, group or individual, refund all monies paid and have no further liabilities.
The skipper will be the sole judge of whether to put to sea, given weather and sea conditions and any other factors that affect the safe navigation of the vessel.
In exceptional circumstances, the skipper may substitute the planned dive site with an alternative site at his discretion. In such circumstances, the skipper will pay due consideration to divers’ gas mixes and abilities, and make every effort to substitute a similar type of dive.
It is understood that all diving is conducted in the individual’s own personal and voluntary capacity, and that he or she accepts responsibility for insuring him or herself against risk of injury or loss.
We will not undertake any responsibility whatsoever for the planning and execution of the dive.
We expect that all divers are of the required standard to undertake the dive and that all trainees and novices are under the supervision of a suitably qualified and responsible person.
In compliance with the Merchant Shipping Act and Protection of Wrecks Act, Marine Quest does not allow charter parties, groups or individuals to lift objects from wrecks. Neither do we allow divers to catch or remove marine life.
The charter party, group or individual shall be responsible for ensuring that all equipment and persons are aboard at the appointed time and that all equipment is correctly stowed.
The charter party, group or individual shall ensure that all diving cylinders are in test.
The charter party, group or individual shall be responsible for any damage caused to the vessel and associated equipment, whether deliberate or accidental.
We will not be responsible for any damage caused to the charter parties, groups or individual’s equipment or personal effects. All equipment left on board overnight is left at the owner’s risk.
Since we operate in unpredictable conditions, cancellations are sometimes unavoidable due to tides, forecasts, sea conditions and other circumstances. We reserve the right to change any route or scheduled trip at our discretion. If a cancellation is our fault, we will offer alternative dates, a credit voucher or a full refund. If a cancellation is due to adverse weather or conditions, we will offer alternative dates or a credit voucher, and you will have no further claim against us.
If we receive notification of your cancellation up to 28 days before the booking date, we will offer alternative dates or a credit voucher free of charge. If you cancel any later, or do not turn up to the scheduled appointment, you will under no circumstances be offered credit vouchers or alternative dates. You will appreciate that at such short notice, we will have made staffing arrangements and may well have turned down other bookings. If there is a possibility you may need to cancel, we advise you to take out travel insurance.
