Liability & Responsibility

​In the event that Marine Quest is unable to put to sea due to mechanical failure or any other operational limitation, we reserve the right to terminate the contract, refund all monies paid, and accept no further liability.

​

We are not liable for any damage to, or loss of, your personal equipment, whether it occurs on the vessel or in the water. Equipment can be stored under the seats, and valuables may be placed in the wheelhouse at your own risk. Items left on board overnight are also left entirely at your own risk.

​

Skipper’s Authority & Dive Site Changes
The skipper has sole authority to determine whether the vessel will go to sea, taking into account weather, tides, sea conditions, and any other safety concerns that affect the safe navigation of the vessel.

​

In exceptional circumstances, the skipper may substitute the planned dive site with an alternative site at his discretion. In such circumstances, the skipper will pay due consideration to divers’ gas mixes and abilities, and make every effort to substitute a similar type of dive.

​

Diving

​All diving is undertaken in each diver’s personal and voluntary capacity. Divers are responsible for insuring themselves against the risk of injury, loss, or damage. We do not plan or supervise dives. Each diver or group must plan and execute their own dive safely and responsibly.

​

We expect that all divers are qualified and competent for the planned dive and have their own kit. Trainees or novice divers must be accompanied and supervised by a suitably qualified individual.

​

All diving cylinders must be in test, and it is the responsibility of the charter party, group, or individual to ensure this, along with having all necessary and functioning equipment.

​

For your safety – and due to the level of boat traffic and changeable sea conditions – we ask that all divers carry a deployable surface marker buoy (SMB) and are confident using it. It’s an essential piece of safety equipment to help ensure divers are visible and can be safely brought back on board.

​

Lifting items from wrecks is strictly prohibited in accordance with the Merchant Shipping Act and the Protection of Wrecks Act. Divers are also not permitted to catch or remove marine life.

​

Personal Responsibilities
It is the responsibility of the charter party, group, or individual to ensure that all persons and equipment are aboard at the agreed time and that all gear is appropriately stowed.

​

You will be held responsible for any damage caused to the vessel or equipment, whether accidental or deliberate.

​

Cancellations & Weather
All trips are subject to sea conditions, weather, and tides. We may need to change dive sites, routes, or departure times with little notice. We will let you know at least 24 hours before 

​

If we cancel a trip due to operational issues, you will receive a full refund, a credit voucher, or the option to rebook.

​

If we cancel due to adverse weather or sea conditions, we will offer alternative dates or a credit voucher as a replacement. In these cases, no further claims will be accepted.

​

For multi-day dive packages, which are charged as a single all-inclusive price (covering diving, accommodation, meals, and other services), any refund or credit for a cancelled day will be a partial amount based on the overall package cost.
Please note: the package is not broken down by individual days or services, so we cannot refund the full cost of a day’s diving. Instead, we will calculate a fair portion based on what elements of the package were impacted by the cancellation.

If you cancel:

More than 28 days before your trip, we will offer alternative dates or credit voucher.

​

Less than 28 days’ notice or in the event of a no-show, no refunds, credits, or alternative dates will be offered.

Please note that we make crew and operational arrangements in advance, and may turn down other bookings for your date. We strongly recommend taking out travel insurance to cover unexpected cancellations.

We will let you know if there are any cancellations or changes at least 24 hours before your arrival. It is recommended that you contact Iain Easingwood on 07780 823884 before setting off for Eyemouth, to check the latest weather and sea conditions. ​​​​​
